Anticipation
We are in the home stretch for the Supremes ruling in the Heller case. The opinion should come down about a month from now. The surly pessimist in me thinks it will be a 5-4 or maybe 6-3 very limited “win” finding the Second Amendment to protect a fundamental right, but little else. I expect thanks in large part to the Bush Administration’s advocated position that a low-level scrutiny will be applied leaving an amendment with no teeth and frankly one barely able to gum soggy toast. W could have stopped the Solicitor General’s sell out at any time but he chose not to. It would not surprise me to see the court to agree with the sell out and send it back to the District Court for a ridiculous exercise in “fact-finding”. Justice Kennedy seems to have, at least temporarily, set aside his desire to be popular at fashionable D.C. cocktail parties and at least on the tenor of his questioning in oral argument would seem to be a solid vote on the freedom side. Having been burned before, I think I will see it to believe it though. For some reason I can’t really put my finger on, Alito worries me. My expectations are so low I don’t know why I worry. No matter how the decision comes down, I am confident it won’t be of much value in stopping the onslaught that will occur starting in January when the Shallow Marxist or the Entitled Female Leftist takes office. Better get the AR you always wanted soon.
